Recipients of invitations from MyColts.net may contact us directly to request the removal of their email address from our database.

Cookies: As with many websites, our Website uses a technology called "cookies." A cookie is a unique, random number that is stored in the browser on your computer. The cookie doesn't actually identify you, just the computer that is used to visit the site. Cookies automatically identify your browser to the Website whenever your computer is used to visit the Website. Cookies also let us know how many people visit the Website and where visitors go on the Website. In addition, cookies can let us know non-personally identifiable information, like what web browser is being used to access the Website. For registered users, cookies can make using the Website easier for you by saving information such as your passwords or preferences. By tracking how and when you use the Website, cookies help us determine which areas are popular and which are not. Many improvements and updates to the Website are based on data obtained from cookies. Accepting cookies allows you, among other things, to personalize your experience on the Website. Cookies may also allow the Website to present to you advertising that may be of special interest to you. If you do not want information collected through the use of cookies, your browser should contain an option that allows you to disable or delete cookie data at any time. Some areas of the Website, however, may not provide you with a personalized experience if you have disabled the use of cookies. The cookies are not tied to personal information

IP Addresses and Click-Stream Data: We may collect IP addresses and/or click-stream data. An IP address is a number associated with the service through which you access the Internet, like your ISP (Internet service provider), your company, or your university. Standing alone, your IP address is not personally identifiable. At times, we also use IP addresses for purposes of system administration and to report aggregate information to our advertisers and sponsors (e.g., regarding the frequency with which our guests visit various parts of our sites). We may combine this information with personally identifiable information. Click-stream data is information collected by our computers when you request certain pages from the Website. Click-stream data may include such information as the page served, the time, the source of the request, the type of browser making the request, the preceding page view and other such non-personal information. When analyzed, this data helps us analyze how visitors arrive at the Website, what type of content is most popular, what type of visitors in the aggregate are interested in particular kinds of content and advertising, and the like.

Transaction Information: If you conduct a financial transaction on our Website, such as buying tickets or official Indianapolis Colts merchandise, we will ask you to complete an order form that will request certain information from you, including contact information, demographic information and financial information. We will use this information to complete the transaction that you have requested, i.e., to deliver the information, products or other services that you order, and to invoice you. For your protection, such information is collected and stored through encrypted means.

HOW WE USE THE INFORMATION COLLECTED

Your user profile information (including your submitted pictures and your first name or user name) are displayed to other users in order to facilitate interaction on the Website. Email addresses may be used for the purposes of inviting new friends to join MyColts.net, to add users to specific networks within the Website, and to send notifications about the Website to registered users. Users within a personal network may communicate with each other on the Website through the MyColts.net service, without disclosing their personal email addresses. However, users' full names and other personal information can be revealed on the Website at the sole discretion of the user. To facilitate searching and finding friends and acquaintances on the service, the Website allows users to opt-in to a search feature that will search all information in a user's profile, but will not disclose that profile information to other users

WITH WHOM THE INFORMATION MAY BE SHARED

At times, we may share your personal information with others for various purposes. The following outlines the ways in which your information may be shared with others and the ways in which you may opt-out of having your information shared:

Agents: We employ other businesses, certain services and individuals to perform functions on our behalf. Examples include fulfilling orders, sending e-mail, Website analysis, analyzing data, providing marketing assistance, processing credit card payments, and providing customer service. They may have access to personally identifiable information needed to perform their functions, but may not use it for their own purposes, like sending you marketing offers about their products.

Opt-In / Opt-Out Offers: When you provide us with personal information, you may be presented with the opportunity to share your personal information with third parties for various purposes, such as receiving information or special offers. An opt-in/opt-out message will ask you if you would like your information to be shared. When you allow us to share your personal information with third parties, we require third parties who have access to that information to agree to abide by our current Website privacy policy. Once the information is transferred, however, we cannot control the privacy practices of these other companies.

Third-Party Offers: Throughout the Website you may be presented with opportunities to receive special offers from third parties. By participating in these offers, you consent to allowing your information to be shared with third parties. When you allow us to share your personal information with third parties, we require third parties who have access to that information to agree to abide by our current Website privacy policy. We cannot control the privacy practices of these other companies, however, and you should review the privacy practices of such companies prior to providing your personally identifiable information.

Other Promotional Offers: We may send offers to you on behalf of our marketing partners. When we do this, we do not give that partner your name and address. If you do not want to receive such offers, you may reply to "Unsubscribe," change your Preference Profile page, or follow instructions provided in each email or mailing.

Third-Party Ad Serving & Audience and Traffic Measurement Services: The Website may use a third party network advertiser to serve the advertisements on the Website or may use a traffic measurement service to analyze the traffic on the Website. Network advertisers are third parties that display advertisements based on your visits to this Website and other Websites you have visited. Third-party ad serving enables us to target advertisements to you for products or other websites you might be interested in. Audience and Traffic Measurement Services allow us to collect anonymous traffic and behavior information from our Website by monitoring anonymous visitor activity. Our current policy is that we do not permit the Website's advertisers, sponsors and/or traffic measurement services to set and access their own cookies on your computer.

Business Transfers: In the event that all or substantially all of our assets are sold or transferred to another party, or another transaction occurs in which your personally identifiable information is one of the business assets transferred, all personally identifiable information that has been collected and saved may be one of the business assets we transfer. See "YOUR ACCEPTANCE OF THE PRIVACY POLICY AND NOTIFICATION OF CHANGES TO THE POLICY" section below.

Administrative or Legal Process: Your personal information may be transferred to third parties without notice to you in order to comply with applicable law, law enforcement agencies, to protect our rights, or protect the rights of other users of this website.

CHAT ROOMS, FORUMS, AND MESSAGE BOARDS

Please be aware that whenever you voluntarily post public information to chat rooms, forums, message boards or any other public forums, that information can be accessed by the public and can in turn be used by those people to send you unsolicited communications. We cannot ensure the security of any information you choose to make public in a chat room, forum or message board. Also, we cannot ensure that parties who have access to such publicly available information will respect your privacy. Please exercise caution when deciding to disclose personal information in these areas.

LINKS TO OTHER WEBSITES

You should be aware that when you are on the Website you could be directed to other Websites beyond our control. For example, if you "click" on a banner advertisement, the "click" may take you off the Website onto a different website. This may include links from advertisers, sponsors and marketing partners who may use the Indianapolis Colts name or logo as part of a co-branding agreement. These other websites may send their own cookies to you, independently collect data or solicit personal information and may or may not have their own published privacy policies. If you visit a website that is linked to our Website, you should consult that website's privacy policy before providing any personal information.

SECURITY

Website users' member accounts are secured by member-created passwords. We take precautions to insure that member account information is kept private. We use reasonable measures to protect member information that is stored within our database, and we restrict access to member information to those employees who need access to perform their job functions, such as our customer service personnel and technical staff. However, please note that we cannot guarantee the security of member account information. Unauthorized entry or use, hardware or software failure, and other factors may compromise the security of member information at any time. For additional information about the security measures we use on the Website, please contact us at issues@colts.com.

This limitation applies to all potential claims, whether based on contract, tort, negligence, strict liability or otherwise, even if we have been advised of the possibility of damages. Because some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you. If you are dissatisfied with any portion of the Site, or with any of these Terms of Use, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE SITE.

Indemnification: You hereby agree to indemnify and hold the Colts, its affiliates, and their respective officers, agents, partners and employees, harmless from any loss, liability, damages, claim or demand (including court costs and reasonable attorneys' fees) made by any third party due to or arising out of your use of the Site in violation of these Terms of Use and/or arising from a breach of these Terms of Use and/or any breach of your representations and warranties set forth above and/or if any of Your Content causes the Colts to be liable to another.

General: These Terms of Use and our relationship is governed by the laws of the State of Indiana, U.S.A. You hereby irrevocably consent to the exclusive jurisdiction and venue of courts in Marion County, Indiana, U.S.A. in all disputes arising out of or relating to the use of the Site. Use is unauthorized in any jurisdiction that does not give effect to these Terms of Use, including this paragraph. No joint venture, employment, or other legal relationship exists between you and the Colts as a result of these Terms or Use or your use of the Site. If any of these terms is held invalid or unenforceable, then it will be deemed superseded by a valid, enforceable provision that most closely matches the original intent, and the remainder of the agreement shall continue in effect. Unless otherwise specified and acknowledged by us in these terms, this is the entire agreement between you and the Colts with respect to the Site. These Terms of Use supersede all prior or contemporaneous communications between you and the Colts concerning any matters set forth herein. A printed version of these Terms of Use and any notices given in electronic form shall be admissible in judicial or administrative proceedings based on or relating to this agreement to the same extent and subject to the same conditions as other business documents originally in printed form.
